Whilst most people these days realise its good practice to have a Will in place most forget that we are all living longer and may encounter problems along the way.
So what do we do? If we have an accident, or get some other medical condition that prevents us from dealing with our day to day affairs? and we need someone to take over for us.
Well you need to have in place a Lasting Power of Attorney. No one is allowed to deal with your Financial and Health affairs without one. Even if your married to one another.
A Lasting Power of Attorney lets you appoint someone to make decisions on your behalf. It’s normally used when someone is unable to make their own decisions.
There are 2 types of Lasting Power of Attorney (LPA) one is for Health and Welfare and the other is Property and Financial. Both must be registered before they can be used.
You can choose to make one type of Lasting Power of Attorney or both.
Health and welfare Lasting Power of Attorney
This allows you to choose 1 person or more to make decisions about things like: -
(1) your daily routine (e.g. eating and what to wear)
(2) medical care ·
(3) moving into a care home ·
(4) refusing life-sustaining treatment
This Lasting Power of Attorney can only be used once someone is unable to make their own decisions.
Property and financial affairs Lasting Power of Attorney
This lets you choose 1 person or more to make decisions about money and property for you e.g:-
(1) paying bills
(2) collecting benefits
(3) selling your home
You can appoint someone to look after your property and financial affairs at any time
